As long as java emulators are not use to host a Lineage Ii server is legal, when you start broadcasting and have players on server you become illegal.
If l2j start to sell this emulator it will become a product = not legal,
Your server is not legal

you are legal as long as you use L2 Java emulator only for you and not go online

Selling Lineage II emulator violates NCZ0ft Copy Right (dos not mater if is in java as long as you have a identical copy of NCZ0ft). The low say you must have under 30% of original to not be a copy :)

The server itself is not illegal. It would be the datapack that is illegal, if anything, because of the use of copywritten works.
