6801 North Capitol of Texas Highway Building One Austin, Texas 78731 May 28th, 2009 Sent via: e-mail Dear Sir or Madam: We have recently received information that someone on your network may be images and/or related information for NCZ0ft Corporation’s Lineage II that has the primary purpose of emulating the Lineage 2 service. Specifically, this activity has been seen on L2Sirius.com which resolves to 72.55.184.149 on the iWeb Technologies Inc. This, if true, is being done in violation of Federal copyright law. As you may be aware, this type of activity may represent a direct infringement of the copyright law and would be punishable under law As per the standards set in the Digital Millennium Copyright Act, we have included the below provisions for notifying a service provider of possible infringing activity: The name, address, and electronic signature of the complaining party Matt Esber, General Counsel and Paul Roberson, Player RelationsNCsoft Corporation6801 North Capitol of Texas Highway, Building OneAustin, Texas 78731 The L2Sirius.com website is hosting a game server on IP range 72.55.184.149 possibly labeled L2authd.lineage2.com The site references and uses Lineage 2 server code for game play. This is not an official Lineage 2 site, nor are they permitted to provide such a service. NCZ0ft has a good faith belief that the use of such material has not been authorized by NCZ0ft, the copyright owner. The content on this site was originally developed by affiliates of NCZ0ft Corporation for use on the official Lineage 2 service. This content is not intended for use by parties other than NCZ0ft. Lineage 2 is a worldwide, massively multiplayer online role-playing game developed and published by NCZ0ft Corporation. Playing the game requires an active account and subscription. Offline play is not possible and is for use only on the official Lineage 2 service. http://www.lineage2.comhttp://www.plaync.com A statement by the owner that it has a good faith belief that there is no legal basis for the use of the materials complained of. The site references and uses Lineage 2 server code for game play. This is not an official Lineage 2 site, nor are they permitted to provide such a service. A statement of the accuracy of the notice and, under penalty of perjury, that the complaining party is authorized to act on the behalf of the owner. Matthew Esber and Paul Roberson both state under the penalty of perjury that this information is accurate, and are authorized to act on behalf of NCZ0ft Corporation. The consequences of copyright infringement can be severe. The copyright law allows the copyright owner to recover either (1) its actual damages plus all of the infringer’s profits that are attributable to the infringement, or (2) statutory damages of up to $100,000 per copyright. The law also provides for the seizure and impoundment (a) of all infringing copies, and (b) of the equipment that was used to make the infringing copies. Injunctive relief is routinely awarded to the copyright owner, and the law permits the prevailing party to recover its attorney’s fees. We have contacted you, the Internet Service Provider (ISP) to make you aware of this activity and the liability this site are placing upon you. Many ISPs have agreed to cancel accounts of those violating agreements with a third party or copyright infringers and to remove and preserve as evidence any files stored on their server owned by a violator or an infringer. As a result of the above, we require that you immediately do the following: Cease and desist any and all actual or intended hosting or dissemination of client/server files and/or or other copyrighted material (collectively, the “Content”); Disable all websites hosting or disseminating the Content; and Provide written verification of the above to us within three (3) days of receipt of this letter. We will be monitoring the above referenced website to see if you are in compliance with the law, the end user license agreement and the rules of conduct. We reserve all of our rights and remedies provided by law. We urge you to give this matter your prompt and serious attention, and we look forward to your immediate response.
