It should be legal if you do it non-profit. However, every country has its own laws, so i recommend you to look after it. All laws suck, anyway!

you are just setting up a server software. Everyone with a client capable to answer the server protocols is able to connect. In that way, we pass the "illegal side" to players, since they are using the nczoft client to connect our server

The illegal part he is reffering to is not from the usage of copyrighted software/trademarks/logos but legal issues arising from making a server.
For example, nobody even pays taxes for their servers. That is illegal.

you dont have to pay anything by set up a free software licensed under GPL. Get in mind l2j isnt designed with the main goal to provide game support for l2 client

You pay taxes to the government of your country. Whenever you get an income, whatever the source might be you ought to pay taxes.Though there are
exceptions to that rule. That is donations to specific organizations that can be considered non-profit,charity etc.
So yes, if you have an income of whatever activity it may be, selling code, selling items, selling website advertisement you have to register that income to get taxed by your Country. If you dont, its tax evasion.

You dont have to pay anything to setup a server, but you have to pay if you make money from it.

Nah, my intention was not to scare you away. And let aside that noone will even search for your economics for small amount of money. Except if someone rats you out. (
PS: This forum has many rats !
)
But anyway ,almost noone in here that hosts a server pays taxes, so you are safe to go make your server and hopefully your killing. Noone has been prosecuded for tax evasion in l2 private servers
